Decisions of the Workers' Compensation Board
The Board of the Livery Fund believes it is important for every person who has an interest in the Fund to know the status of the law and the applicability of benefits, as such is determined by the decisions of the Workers' Compensation Board. The below are links to important cases with a brief synopsis.
In Re Ibrahima Sow- If the injured livery driver did not sustain one of the injuries enumerated in the Executive Law or the WC Board regulations, then the Workers’ Compensation Board doe snot have jurisdiction over the case and the claim must be disallowed. (Driver entitled to No-Fault benefits);
In Re Mohammad Anwar- the Livery Fund only covers a driver when he/she is on a dispatched call from a member livery base. The Livery Fund does not cover a driver of a street hail livery when the driver is involved in an accident while on a street hail.
In Re Carlos Nunez- a livery driver is not covered by the Livery Fund when they are involve din an accident while operating a vehicle that is not a for-hire vehicle. A personal vehicle that is not a for-hire vehicle is not a livery for purposes of coverage under the Executive Law.
