SUBMISSION OF TRIP RECORDS

All livery bases that are members of the New York Independent Livery Driver Benefit Fund (“ILDBF”) must each upload their monthly trip records, starting with trips for the month of January 2022 to the ILDBF’s new Member Portal.

 The trip records for each base must be submitted every month. The format is the same as is used to submit your trip records to the NYC Taxi and Limousine Commission. Click here for a sample copy of the report format for your quick reference

The format that is required is the same as is required by the NYC Taxi and Limousine Commission (“TLC”). The quicker each member base uploads their trip records, the more accurate the billing and charges will be.

The following Livery Bases are members of the Fund but have yet to create an account to upload their records. If your base is on this list, then you must register immediately. The failure to do so may result in an audit by the Fund as is permitted by Workers' Compensation Law Section 18-c.

If this is your first time visiting the Members Portal:

Ø  Click on “Create Account”

Ø  Fill in the required information

Ø  Click on “Create Account”

If you already have an Account:

Ø  Enter your email address; and

Ø  Enter your base number; and

Ø  Enter a PIN code; and

Ø  Upload your trip records.

As previously advised, the Workers’ Compensation Board enacted emergency regulations that redefined the definition of an independent livery driver. The new definition includes a black car operator when the black car operator is dispatched by an independent livery base. The emergency regulation also created a new regulation that expanded the required contributions to the ILDBF. The initial per-trip surcharge for all trips dispatched by a member livery base to a black car or other non-livery vehicles will be a 21.5 cents per trip. As such, the ILDBF will assess its members a 21.5 cent membership fee charge on each trip dispatched to a non-livery TLC licensed vehicle, up to $195 per non-livery vehicle (the “CAP).

To properly assess reaching the CAP per vehicle, members shall be REQUIRED to self-report all dispatches to the ILDBF on a monthly basis, in the same format as the submission required by the TLC. Absent a member providing this data to the ILDBF, all such bases will be charged the 21.5 cents per-trip fee based on NYC Open Data, which only identifies the affiliated base, but does not provide the vehicle information. Thus, members failing to provide the data to the ILDBF may not enjoy the benefit of the CAP.

Additionally, due to the delay in TLC posting of data, the ILDBF will charge any base that does not self-report an estimate based on the data made publicly available by the TLC. Thus, providing the monthly report to the ILDBF is beneficial to all ILDBF members.

The failure to properly and timely upload each month’s trip records to the ILDBF will not alleviate each member’s liability for the 21.5 cent per-trip surcharge. It is to the benefit of each member livery base that each member timely submit their trip records on a monthly basis. That is the only way the ILDBF can determine if sufficient trips were sent to any non-livery vehicle, so as to meet the CAP. If the CAP is met for any non-livery vehicle then any livery base that sends further dispatches to such a vehicle will not incur any further surcharges for the calendar year.
